Terms of Service
Generaitiv is a community-driven AI platform uniting Artists, AI Model Creators, and Collectors. Generaitiv is built to empower AI contributors by recognizing and rewarding their efforts through scalable grass-roots approaches.
1. Acceptance of Terms
In these Terms, Generaitiv is also referred to as “the Service”, “we”, “us” and “our”.
"You" and "user" refer to individuals using the Service, including those doing so on behalf of another individual.
"User content" encompasses any images, data, transaction records, and feedback promoted or displayed by users of the Service.
Acceptance of these Terms also signifies agreement to our separate Privacy Policy.
By accessing and using Generaitiv, you agree to abide by the terms outlined in the Terms of Service. You confirm that you have the authority to agree on behalf of any individual or entity for whom you use the Service. Generaitiv reserves the right to restrict or revoke access for those who violate these terms.
2. Disclaimers
You acknowledge that accessing and using Generaitiv is solely at your own risk. We do not guarantee the security or uninterrupted availability of the Service, nor do we ensure that information provided through the Service will be reliable, accurate, current, or complete. Generaitiv is not liable for any harm caused by errors, viruses, or harmful elements which may be associated with use of the Service.
3. Assumption of Risk
By using Generaitiv, you acknowledge and accept the following: Asset values are subject to market fluctuations and may vary greatly, we cannot guarantee the preservation or growth of their value. You are solely responsible for determining and paying any applicable taxes related to your activities on the Service. Generaitiv's services are non-custodial, meaning that we never hold control over the NFTs displayed in the Service. Digital assets remain on the blockchain and we do not handle their transfer, storage, or storage of their data (in the case of "Lazy Minted" assets, data will temporarily be held on Generaitiv's servers until they are minted to the blockchain). Given the decentralized nature of the blockchain and the services provided, it is your sole responsibility to secure your wallet(s) and assets from potential risks. You accept responsibility for any risks associated with purchasing user-generated content, including (but not limited to) the risk of purchasing:
Assets which become untransferable
Counterfeit assets
Misrepresented assets
You are solely accountable for all interactions and dealings within the Service and on the blockchain. Generaitiv is not responsible or held liable for any disputes between users or third parties.
4. Intellectual Property & User Content
Generaitiv owns the rights to all intellectual property created for us by contributors, including logos, text, images, and copyrights. You retain the rights to the content you submit to Generaitiv, provided you have the necessary permissions, licenses, and authority. Generaitiv holds worldwide, non-exclusive rights to display and modify user submitted content for promotional and improvement purposes, but doesn't claim ownership.
Generaitiv may remove or block access to content that violates Intellectual Property laws or these Terms of Service.
5. Eligibility Requirements
To use Generaitiv, you must comply with all applicable laws and regulations within your jurisdiction and your use of the Service must not involve any illegal activities.
You must be of the age of majority in your jurisdiction, or have the supervision of a legal guardian if you are between the ages of 13 and 17. Minors within this age range may use the Service under the account of their legal guardian.
6. Prohibited Actions
By accessing or using Generaitiv, you accept full responsibility for your behavior and actions within and regarding the Service, and agree to comply with all relevant laws and agreements. You also agree to refrain from engaging in any activities that may violate laws, contracts, or Generaitiv’s policies as noted below in connection with your use of the Service.
Engaging with wallets/blockchain addresses under sanctions or trade embargoes.
Infringing intellectual property rights, such as copyrights, trademarks, patents, etc.
Engaging in malicious behavior that causes harm to other users or the Service.
Interacting with harmful or illegal content, such as content: promoting self-harm, inciting violence or hate, exposing personal information, depicting minors in sexual situations, or supporting terrorism or criminal organizations.
Suspicious activity patterns, such as data scraping or deliberately misrepresenting assets.
7. Limitation of Liability
By utilizing Generaitiv and its offerings, including the $GAI token, you acknowledge and accept that Generaitiv shall not be held responsible for any damages that may result from your use of the Service, such as loss of digital assets, monetary funds, or intangible property.
Generaitiv is not liable for damages of any kind resulting from or relating to use of the Service including (but not limited to):
Content inaccuracies in the Service or Generaitiv affiliated media.
Unauthorized access to Generaitiv's servers or databases, software bugs and viruses, service interruptions, or third-party behavior.
Generaitiv is not responsible for any content on third-party websites or entities referenced or linked to through its channels. Any such references or links are provided solely for convenience and do not indicate endorsement or affiliation.
8. Privacy
By accessing or using the Service, you agree to the terms outlined in our Privacy Policy, which details how we collect, use, and disclose your personal data. Your use of the Service signifies your consent to these practices.
9. Modification of Terms of Service
Generaitiv reserves the right to modify this Agreement at any time, and in our sole discretion without notice. Modifications enter effect upon posting.
